Guwahati: The special POCSO Court of Dhubri, Assam has directed stringent punitive measures against a complainant who allegedly filed a false complaint under the Act that ensures strict action against people who commit sexual offenses against minors.
The incident dates back to October 13, 2023, when an FIR, registered as special case no. 371/2023, was filed at Agomoni police station in Dhubri district.
The accused, Alomgir Rahman, was subsequently detained on November 30, 2023, and remained in custody until January 30, 2024.
The complainant, Kudrat Ali, father of the 16-year-old victim, made grave allegations in the FIR, accusing Rahman of raping his underage daughter, coercing nude images from her, and blackmailing her based on those photographs.
However, as the ongoing trials entered its fifth month, the complainant Kudrat Ali retracted from his previous stand and informed the Court that he filed the FIR with false information out of personal animosity.
In his testimony before the Court, the complainant said that he filed the false complaint with the police after being aggrieved by the accused person’s consistent efforts to convince his daughter of a love affair. He had even advanced marriage proposals to the minor girl on multiple occasions that were eventually turned down.
Rituparna Guha, the special public prosecutor of the court, emphasized the significance of maintaining the seriousness and responsiveness of POCSO cases.
Despite the false allegations, bench assistant Saurav Karmakar submitted a written complaint under Section 22 of the POCSO Act against Kudrat Ali, the informant in Special Case No. 371/2023, for lodging a false FIR against Alomgir Rahman, as directed by Mamta Bhadani, Additional Sessions Judge cum Special Judge, POCSO, Dhubri.
Subsequently, a case has been filed against the defendant, Ali, under Chief Judicial Magistrate (CJM) case no. 3366/2024, as per relevant penal provisions. Rituparna Guha, the special public prosecutor, and Jonali Devi, the investigating officer WSI(P), will lead the witness testimony in the case.
